विधानसभा सचिवालय में राज्य बनने से पिछली विधानसभा तक में नियुक्तियों में नियमों का घोर उल्लंघन किया गया। आरक्षण के प्रावधानों को दरकिनार करने के साथ ही चयनित अभ्यर्थियों की शैक्षिक योग्यता व अन्य योग्यता की सक्षम अधिकारियों ने जांच नहीं की और विचलन के आधार पर नियुक्ति दे दी।
हाई कोर्ट में दायर जनहित याचिका में पारित आदेश के अनुपालन में विधानसभा सचिवालय की ओर से करीब साढ़े चार सौ पेज से अधिक का शपथ पत्र दाखिल किया गया है। जिसमें साफ कहा है कि कार्मिक विभाग के मना करने तथा वित्त विभाग की आपत्तियों को दरकिनार कर नियुक्तियां की गई, साथ ही सरकार में महत्वपूर्ण पदों पर बैठे लोगों ने नियुक्ति व वेतन के आदेश जारी किए।
सरकार में शामिल लोगों ने खूब दरियादिली दिखाई:
विधानसभा की ओर से दाखिल शपथ पत्र में संलग्न जांच कमेटी की रिपोर्ट का जिक्र करते हुए कहा है कि 2016, 2020 और 2021 में नियुक्तियां की गई, जिसमें नियमानुसार चयन समिति का गठन, आवेदन आमंत्रित करने, प्रतियोगी परीक्षाओं आदि सहित भर्ती के लिए एक विस्तृत प्रक्रिया निर्धारित है, लेकिन नियमों में निर्धारित किसी भी प्रक्रिया का पालन नहीं किया गया है। कार्मिक विभाग ने ऐसी नियुक्तियों पर आपत्ति जताई थी। परिणामस्वरूप नियुक्तियां अवैध थीं और उन्हें उचित रूप से समाप्त कर दिया गया।
2011 के नियमों के नियम-सात में सरकार के प्रचलित आदेशों के अनुसार अनुसूचित जाति, अनुसूचित जनजाति, अन्य पिछड़ा वर्ग और अन्य श्रेणियों के लिए आरक्षण का प्रावधान है, नियुक्ति करते समय नियम सात के प्रावधानों का अनुपालन नहीं किया गया है. नियुक्तियां करने के लिए शैक्षिक एवं अन्य योग्यताओं की जांच सक्षम प्राधिकारियों से की जानी आवश्यक है, जो नहीं की गई। 2011 के नियमों का नियम-नैा शैक्षिक और अन्य योग्यताओं का प्रावधान करता है। 2011 के नियमों के नियम 11 से 14 आयु, चरित्र, वैवाहिक स्थिति और शारीरिक क्षमता सहित कई अन्य पात्रता मानदंड प्रदान करते हैं।
सुप्रीम कोर्ट के आदेश का दिया हवाला:
शपथ पत्र में सर्वोच्च न्यायालय के एक आदेश का विशेष उल्लेख किया है। जिसमें कहा है कि कानून का शासन संविधान की मूल विशेषता है। कोई भी प्राधिकारी कानून से ऊपर नहीं है और कोई भी व्यक्ति कानून से ऊपर नहीं है। अनुच्छेद 13 संविधान के (2) में प्रावधान है कि ऐसा कोई कानून नहीं बनाया जा सकता जो संविधान प्रदत्त मौलिक अधिकारों के विपरीत हो। अनुच्छेद 13 का मुख्य उद्देश्य संविधान की सर्वोपरिता को सुरक्षित करना है, खासकर मौलिक अधिकारों के संबंध में। “कानून के शासन” के कानूनी सिद्धांत के साथ और अंग्रेजी न्यायविद्, हेनरी डी ब्रैक्टन के प्रसिद्ध शब्दों की याद दिलाते हैं कि राजा किसी व्यक्ति के अधीन नहीं बल्कि भगवान और कानून के अधीन है। कोई भी कानून से ऊपर नहीं है। चाहे आप कितने भी ऊंचे क्यों न हों, कानून आपसे ऊपर है। सभी पर लागू होता है, चाहे उसकी स्थिति, धर्म, जाति, पंथ, लिंग या संस्कृति कुछ भी हो। संविधान सर्वोच्च कानून है. संविधान के तहत बनाई जा रही सभी संस्थाएं, चाहे वह विधायिका हो, कार्यपालिका हो या न्यायपालिका, इसकी अनदेखी नहीं कर सकतीं। किसी प्राधिकारी द्वारा शक्तियों का प्रयोग अनियंत्रित या निरंकुश नहीं हो सकता क्योंकि संविधान प्रत्येक प्राधिकारी के लिए सीमाएं निर्धारित करता है और इसलिए, किसी को भी, चाहे वह कितना भी बड़ा क्यों न हो, उस उद्देश्य से परे शक्ति का प्रयोग करने का अधिकार नहीं है जिसके लिए उसे अधिकार प्राप्त है। शक्तियों का प्रयोग संविधान और विधायी प्रावधानों के ढांचे के भीतर किया जाना चाहिए।
